Retention of Personal Information

We retain your Personal Information for the period reasonably necessary to provide goods and services to you, as applicable, and longer as may be required by applicable laws or necessary for our business purposes listed in the chart above.

Children's Personal Information

We generally do not knowingly collect or process Personal Information of children under 13 years of age. We also do not have actual knowledge that we Sell or Share Personal Information of California Consumers who are under 16 years of age. If and when we do so, we comply with the Children’s Online Privacy Protection Act (“COPPA”).

Purposes for Processing Sensitive Personal Information

We, and our service providers, collect and process the Sensitive Personal Information described in this Supplemental Notice only for:

  • Short-term, transient use, provided that we will not disclose the Consumer’s Personal Information to a third party and will not build a profile about the Consumer or otherwise alter the Consumer’s experience outside of their current interaction with us;
  • Performing services on our behalf, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on our behalf;

Data Subject Rights

Consumers who reside in states with U.S. Privacy Laws have the right to request certain information regarding the Personal Information we have collected about you in the preceding 12 months. You may make such a request up to twice in a 12-month span. Please note that there are circumstances in which we may not be able to comply with your request pursuant to the CCPA, including when we cannot verify your request and/or when there is a conflict with our own obligations to comply with other legal or regulatory requirements. We will notify you following submission of your request if this is the case.

  • Right to Deletion: You may request that we delete any Personal Information about you we that we collected from you.
  • Right to Correction: You may request that we correct any inaccurate Personal Information we maintain about you.
  • Right to Non-Discrimination: You have the right not to be discriminated against for exercising your data subject rights. We will not discriminate against you for exercising your data subject rights.

Verification

To help maintain security around your information, we ask that you provide a few pieces of information about yourself. We will only use the information you provide to verify your identity and the Personal Information that is relevant to your request. We will retain a record of your request, but we will not retain the information you provide beyond the period of time necessary to respond to your request.

Authorized Agents

You may designate an authorized agent to exercise your rights under the U.S. Privacy Laws on your behalf. In such instances, authorized agents may use the same methods as Consumers to submit data rights requests on Consumers. We may verify your authorized agent by asking for a written permission from you, requiring that you verify your own identity directly to us, or asking for a valid power of attorney under California Probate Code sections 4000 to 4465.

Tom James Company ("Tom James Co.", "The Organisation") is committed to respecting the privacy of our customers across the world who entrust us with their Personal Information. In order to manage the employment relationship, Tom James Co. will collect, process, store, transfer, disclose, delete, and use your data. Your data may be used internally or disclosed to other non-affiliated parties in certain circumstances. Tom James Co. is committed to being transparent about the use of your data and to meeting its data protection obligations.

Tom James Company entities covered by this supplemental policy are Oxxford Clothes, Individualized Shirts, English American, Measure Up, Gitman Brothers, Gitman Vintage, Coppley, Corbin Trousers, TJ Chile, H Freeman, Holland & Sherry, Holland & Sherry Interiors, Holland and Sherry Bespoke, Clissold, Rochester Tailored Clothing, and Crossville (collectively "Tom James Company").

What information does the organisation collect?

The organisation collects and processes a range of information about you. This includes:

  • your name, address and contact details, including email address and telephone number and your work address;
  • contact details of your spouse/ partner or assistant if you prefer us to liaise with them directly instead of yourself for booking appointments;
  • a record of our communications with you;
  • your shopping preferences, budget, suit and shirt styling preferences;
  • your marketing preferences and interest in certain promotional events or offers;
  • your measurements;
  • pictures we have taken of you, with your explicit consent;

Where does your Personal Information come from?

The organisation collects your personal data in a variety of ways. You provide some of your personal information to us directly by interacting with your Sales Professional. We may also collect your personal information from your social media platforms, including Facebook, YouTube, LinkedIn, and Instagram or as the result of internet searches which access information that exists in the public domain. We may also collect your personal information from non-digital media that exists in the public domain, like newspapers or trade publications. In some cases, we may also collect your personal information from an existing client that referred you to us.

Why does the organisation process Personal Information and the legal basis for doing so?

The Company will only process Personal Information where it has a legal basis for doing so. The company will review the Personal Information it holds on a regular basis to ensure it is being lawfully processed, and is accurate, relevant and up to date. Before transferring Personal Information to a non-affiliated party such as a supplier, the company will establish that it has a legal reason for making the transfer.

The legal bases that we use for processing Personal Information are:

  • Contractual necessity - for example to deliver the clothing you have paid for
  • Compliance - fulfilment of a legal obligation

Who has access to your Personal Information?

Your personal data will be internally disclosed to and accessed by our customer services team, accounting employees, and factory personnel so that we can provide you so with the goods and services that you have purchased or otherwise requested.

The organisation will not disclose your Personal Information to non-affiliated parties, like external suppliers, beyond what is required for the legal bases described above, such as to fulfil your order, for compliance purposes such as financial auditing or for compliance with requests from legal and regulatory authorities.

Tom James has recommended retention periods for particular data some of which are enforced by legal or regulatory authorities.

If you have asked to be put on our suppression list for marketing purposes, we will only retain your contact information that is required for us to identity you as someone who does not wish to be contacted going forward.

Your data protection rights

As a data subject, you have a number of rights. Your rights are as follows:

  • The right to be informedwith clear and transparent information about our data processing activities, as detailed in this privacy policy;
  • Right to access and obtain a copy of your data on request free of charge. If there are exceptional circumstances that mean we can refuse to provide the information we will explain them;
  • Right to rectification - we will rectify incorrect or incomplete data;
  • Right to restrict processing - we will still hold the data but not process any further, in the event that the processing is unlawful, the data is inaccurate or the right to object is pending;
  • Right to be "forgotten" (erasure) - you may request the deletion of your data where no overriding legitimate interest continues to exist;
  • Right to object to the processing of your data where the organisation is relying on its legitimate interests as the legal ground for processing; processing is for the purpose of direct marketing, processing involves automated decision making or profiling;
  • Right to portability - you may request a copy of your personal data to be transferred to another data controller if it was originally processed by automated means and if the processing was on the basis of consent or the fulfilment of a contractual obligation.
